maintains the Voluntary Appeal File database (“VAFˮ), which
allows any applicant to apply by submitting an appeal request and
then obtain a UPIN. A person who has been cleared through the VAF
and received a UPIN is able to use their UPIN when completing
Form 4473 in order to help avoid further erroneous denials or
extended delays. A person can obtain a UPIN by following the
procedures outlined on the FBI’s website at www.fbi.gov.
Traditionally, there has been a long delay in processing a UPIN
application; there may be an alternative. Another option available
to a prospective purchaser that may yield a quicker resolution is
a firearm-related challenge (appeal). You may only challenge
a denied (not a delay) firearm transaction in this manner. This
process will provide the reason a background check was denied and
allow the challenging of a denial. Unlike with the VAF application,
the applicant will not receive a UPIN. Rather, if a firearm-related
challenge is successful, the FBI will clear the denial for a singular
purchase. If you are repeatedly delayed or denied a firearm purchase,
the VAF is recommended to expedite future purchases as well. A
person can obtain a UPIN or request a firearm-related challenge by
following the procedures outlined on the FBI’s website at www.
fbi.gov.
VII. ADDITIONAL CONSIDERATIONS IN FIREARMS PURCHASING
AND POSSESSION LAWS
A. How can I legally purchase a firearm from someone in
another state?
Any individual who wishes to purchase a firearm from a person
that lives in another state than the purchaser must complete the
transaction through an FFL. Sellers or transferors are legally
