as defined in Texas Penal Code Section 30.04 or “burglary of a
coin-operated machine” as defined in Texas Penal Code Section
30.03 are included in the scope of the term “burglary” under Texas
Penal Code Section 9.42. There exist legal arguments both for the
inclusion and exclusion of these two crimes; however, until a court
of appeals addresses the issue, they remain mere arguments.
E. Robbery
When, in the process of committing theft, a person intentionally,
knowingly, or recklessly causes bodily injury to another; or
intentionally or knowingly threatens or places another person in
fear of imminent bodily injury or death while intending to obtain or
maintain control of the stolen property. See Tex. Penal Code § 29.02.
F. Theft
When a person unlawfully appropriates property with the intent to
deprive the owner of the property. See Tex. Penal Code § 31.03.
G. Criminal Mischief
When a person, without the effective consent of the owner:
intentionally or knowingly damages or destroys the tangible
property of another; tampers with the tangible property of another
and causes pecuniary loss or substantial inconvenience to the
owner or a third person; or makes markings, including inscriptions,
slogans, drawings, or paintings, on the tangible property of another.

H. Nighttime
The period of time beginning thirty minutes after sunset and ending
thirty minutes before sunrise. See Tex. Transp. Code § 541.401.
