4. What happens if my LTC expires while it is suspended?
If you are unfortunate enough to have your Texas LTC expire
during your period of suspension, you may or may not be able to
renew your license. A Texas LTC must be renewed within one year
after the expiration to avoid retaking the class, paying fees, and
submitting a new application. If more than a year has elapsed since
expiration or during the period of suspension, you will have to
reapply from step one. See 37 Tex. Admin. Code § 6.16.
5. Procedure for revocation or suspension of an LTC
LTCs are not automatically suspended or revoked even if one of the
elements of revocation or suspension as discussed above apply—the
revocation or suspension requires law enforcement action before it
actually occurs. Texas law allows a law enforcement officer to seize
the physical LTC card of a person who the officer suspects will
be subject to revocation or suspension. Once dispossessed of their
physical LTC card, a person effectively no longer possesses an LTC
because they must have physical possession of their LTC to carry
under the authority of an LTC. However, regardless of whether the
officer does seize the physical LTC card, the officer will complete
an affidavit stating the reasons why revocation or suspension is
recommended and forward the affidavit to DPS. DPS will then
make a decision on whether to revoke or suspend the license. If DPS
decides to proceed with the revocation or suspension, then DPS
will send the LTC holder a letter stating the reason for revocation
or suspension and require the LTC holder to surrender their license
to DPS within 10 days of receipt of the letter unless the person
requests a hearing and the request is received by DPS within 30
days of receipt of the letter. See Tex. Gov’t Code § 411.185.
