An out-of-state handgun carry license or permit holder must
follow Texas law while in Texas, just like a Texas LTC holder must
follow the law of the state they are visiting. Additionally, with the
exceptions of firearms transactions and carrying in federal gunfree school zones, license or permit holders from other recognized
states enjoy the same benefits as Texas LTC holders.
B. Facilitating firearm transactions
Generally, every person who purchases a firearm from a Federal
Firearms Licensed dealer (“FFL”) is subject to a background check
through the National Instant Criminal Check System (“NICS”).
Going through this system can sometimes lead to delays and
erroneous denials due to mistaken identity. However, no NICS
background check may be required if the transferee is legally
exempt for reasons such as possessing a state-issued firearms
license like a Texas LTC. See 18 U.S.C. § 922(t)(3).
Additionally, as many saw during the COVID-19 pandemic,
firearms may be in such demand, and the availability so sparse, a
license or permit to carry might get you that last firearm while the
other guy is still waiting on his background check. For many who
had LTCs, they were able to purchase a firearm without having to
wait on NICS. For those who did not have an LTC and therefore
needed a background check completed before they were allowed to
purchase the firearm from the FFL dealer, they may have lost out
on the ability to purchase. In times like these, although they may be
rare, an LTC can be helpful for the law-abiding gun owner.
