IV. TEXAS PENAL CODE SECTION 46.03: PLACES PEOPLE SHOULD
NOT CARRY
As a reminder, the Texas Firearm Carry Act of 2021 made many
changes to firearm laws in the State of Texas. Included in these
changes was a major reorganization of prohibited places within the
Texas Penal Code.
In this Chapter, we will discuss the certain places where all firearms,
including long guns and handguns, as well as other prohibited
weapons such as knives with blades longer than 5½ inches, clubs,
and the weapons listed in Section 46.05(a) of the Texas Penal Code,
are forbidden. The most notable places a person may generally
never carry are listed in Section 46.03 of the Texas Penal Code.
In these places, a person is prohibited from possessing firearms
or prohibited weapons on their premises, regardless of whether a
person has an LTC or is legally allowed to possess firearms or other
weapons. Remember, “premises” is defined in Texas Penal Code
Section 46.03 as “a building or a portion of a building. The term
does not include any public or private driveway, street, sidewalk or
walkway, parking lot, parking garage, or other parking area.” Tex.
Penal Code § 46.03.
These prohibited places generally include schools, polling
places, courts, racetracks, airports, within 1,000 feet of a place
of execution, 51% locations, scholastic and professional sporting
events, correctional facilities, civil commitment facilities, hospitals,
amusement parks, and a room of an open government meeting.
