institution, as well as any grounds or building where a schoolsponsored activity is taking place. This means that if the marching
band is practicing in the parking lot of a school—a place where a
firearm is otherwise permitted—then while the band is participating
in its activity, firearms and other weapons are prohibited.
It is important to note that the prohibition on firearms possession
can be waived by the institution by giving written permission or
creating written regulations.
B. Polling places
WEAPONS PROHIBITED AT POLLING PLACES
TEX. PENAL CODE § 46.03(a)(2)
(a) A person commits an offense if the person intentionally,
knowingly, or recklessly possesses or goes with a firearm,
location-restricted knife, club, or prohibited weapon listed in
Section 46.05(a):
(2) on the premises of a polling place on the day of an election
or while early voting is in progress; ...
The possession of firearms (both handguns and long guns) and other
weapons is prohibited at any place where polling for an election is
taking place, including places where early voting is in progress.
Many polling locations are often at places where firearms are not
ordinarily prohibited, such as churches, governmental buildings,
and libraries. However, while voting is taking place, those locations
become off-limits for firearms and other weapons.
