Texas Penal Code Section 46.01 defers to Texas Occupations Code
Section 2021.003(41), which defines “racetrack” as “a facility
that is licensed under this subtitle for the conduct of pari-mutuel
wagering on horse racing or greyhound racing.”
However, for security officers, it is a defense to prosecution that
the actor possessed a firearm or club while traveling to or from
the actor’s place of assignment or in the actual discharge of duties
as a security officer commissioned by the Texas Board of Private
Investigators and Private Security Agencies, if: the actor is wearing
a distinctive uniform; and the firearm or club is in plain view. See
Tex. Penal Code § 46.03(h).
E. Airports
WEAPONS PROHIBITED AT AIRPORTS
TEX. PENAL CODE § 46.03(a)(5)
(a) A person commits an offense if the person intentionally,
knowingly, or recklessly possesses or goes with a firearm,
location-restricted knife, club, or prohibited weapon listed in
Section 46.05(a):
(5) in or into a secured area of an airport; ...
No weapons are permitted in the secured area of an airport under
Texas law. The “secured area of an airport” refers to all areas in the
airport past security and metal detectors.
However, there are specific defenses pertaining to taking a handgun
into the secured portion of an airport and one notable ability for a
Texas LTC holder to avoid an arrest.
