must allow the Texas LTC holder to depart. Only if the Texas LTC
holder does not immediately depart may the officer arrest the actor
for a violation under this section.
Still, it is important to remember that this defense is only applicable
to the crime of violating Texas Penal Code Section 46.03(a)(5) and
does not affect any penalties that the TSA may choose to impose on
the person for violating its rules.
F. Places of execution
WEAPONS PROHIBITED AT PLACES OF EXECUTION
TEX. PENAL CODE § 46.03(a)(6)
(a) A person commits an offense if the person intentionally,
knowingly, or recklessly possesses or goes with a firearm,
location-restricted knife, club, or prohibited weapon listed in
Section 46.05(a):
(6) within 1,000 feet of premises the location of which is
designated by the Texas Department of Criminal Justice
as a place of execution under Article 43.19, Code of
Criminal Procedure, on a day that a sentence of death is
set to be imposed on the designated premises and the
person received notice that:
(A) going within 1,000 feet of the premises with a weapon
listed under this subsection was prohibited; or
(B)
possessing a weapon listed under this subsection
within 1,000 feet of the premises was prohibited; ...
It is prohibited to take a weapon within 1,000 feet of the premises
where an execution is scheduled to be carried out as long as the
person possessing the weapon was provided with notice that
