Additionally, Texas Penal Code Section 46.15 explains that
46.03(a)(7) does not apply to an individual who carries a handgun
as a participant in a historical reenactment performed in accordance
with the rules of the Texas Alcoholic Beverage Commission.
Otherwise, if the business has not posted a 51% sign but derives
the majority of its income from the sale and service of alcoholic
beverages, an LTC holder has a defense if carrying in that location.
However, as we mentioned previously, a person carrying under
Texas Constitutional Carry does not have that defense and must
magically divine whether or not the business is a 51% location. So,
although LTC holders have an extra possible defense, constitutional
carriers do not.
