collegiate, and professional sporting events, such as a tailgate party
in the parking lot. As always, however, watch for effectively posted
Texas Penal Code Section 30.05, 30.06, 30.07, or other applicable
signs in areas where you wish to carry.
I. Correctional facilities
WEAPONS PROHIBITED AT CORRECTIONAL FACILITIES
TEX. PENAL CODE § 46.03(a)(9)
(a) A person commits an offense if the person intentionally,
knowingly, or recklessly possesses or goes with a firearm,
location-restricted knife, club, or prohibited weapon listed in
Section 46.05(a):
(9) on the premises of a correctional facility; ...
A person is not permitted to carry an open or concealed handgun
into a correctional facility (the statute makes no distinction between
public/private correctional facilities, state prisons, municipal jails,
etc.) under Texas law. A person is not prohibited, however, from
carrying the handgun in the parking lot or other area not considered
the “premises” of the facility. Note: Texas Department of Criminal
Justice facilities have specific rules about securing a gun in your
car when you visit an inmate. See Texas Dep’t of Criminal Justice,
