An LTC holder may legally carry on the premises of a hospital,
nursing home, or amusement park if effective Texas Penal Code
Section 30.06 or 30.07 notice has not been provided. Because of
the manner in which the law is written, this area of the law causes
confusion. It is because Texas Penal Code Section 46.03 states that
these areas are prohibited places, only to be trumped by a later
section that says an LTC holder may carry unless they are given
effective notice under Section 30.06 or 30.07. This exception comes
from Texas Penal Code Section 46.15(p), which reads:
(p) Sections 46.03(a)(7), (11), and (13) do not apply if the actor:
(1) carries a handgun on the premises or other property, as
applicable;
(2) holds a license to carry a handgun issued under Subchapter
H, Chapter 411, Government Code; and
(3) was not given effective notice under Section 30.06 or
30.07 of this code or Section 411.204, Government
Code, as applicable.
So, although a hospital, nursing home, and amusement park are
generally prohibited places, an LTC holder may carry into those
locations as long as he or she is not given notice under Section
30.06 and 30.07. For non-LTC holders, these areas are strictly
prohibited.
