A. Do I legally have to present my LTC to a police officer if they
ask for my identification and I am carrying my gun?
REQUIREMENT TO DISPLAY LICENSE
TEX. GOV’T CODE § 411.205
If a license holder is carrying a handgun on or about the license
holder’s person when a magistrate or a peace officer demands
that the license holder display identification, the license holder
shall display:
(1) both the license holder’s driver’s license or identification
certificate issued by the department and the license
holder’s handgun license; and
(2) if the license holder’s handgun license bears a protective
order designation, a copy of the applicable court order
under which the license holder is protected.
Yes, but there is no legal penalty if you fail to present the LTC.
Texas LTC law has always required that a person present their LTC
along with their driver’s license or other state-issued identification
anytime they are carrying a concealed handgun, or a handgun
visible in a holster, and they have been asked for identification
by a law enforcement officer or a magistrate. See Tex. Gov’t Code
§ 411.205.
While this is and always has been the law, there is no penalty for a
person who fails to present their LTC to law enforcement upon
request for identification. However, the law requires that a person be
in possession of their LTC at all times that they are carrying pursuant
