EXAMPLE:
Kevin, a 14-year-old boy, does not like his neighbor. One day,
he retrieves the family 12-gauge shotgun and decides to shoot
the neighbor’s fence. Kevin’s parents know nothing about this
behavior, and Kevin has never had trouble with a firearm in the
past. As a result of the shooting, a number of pickets from the
fence were destroyed, three windows were broken, and numerous
pockmarks were left in the brick façade of the home.
Under the second subsection of Texas Family Code Section
41.001, Kevin’s parents would be liable for the damage Kevin
caused to his neighbor’s property, up to $25,000 plus court costs
and reasonable attorneys’ fees, because Kevin’s actions were
willful and malicious.
