I. INTRODUCTION AND OVERVIEW
he text of the Fourth Amendment requires
that the government have a warrant based on
probable cause when they want to invade our privacy
or place us under arrest. Unfortunately, the words of
the Fourth Amendment are not the end of the story.
Over the years, the courts and the legislature have
chipped away at the warrant requirement and created
an incredible number of exceptions. So many, in fact,
that today there are far more searches and seizures
conducted without a warrant than with one. Despite
this sad reality, warrants remain the general rule, and
it is important to understand how they are obtained
and executed.
