4. Municipalities may not impose their own regulations regarding
knives!
In 2015, the Texas Legislature added knives to the list of weapons
covered by the Texas preemption law. See Tex. Loc. Gov’t Code
§ 229.001, discussed in Chapter 1. Local municipalities, government
agencies, and other regulatory bodies cannot enact laws, ordinances,
and rules regulating knives that are more restrictive than state law,
which, thanks to the Texas Legislature, is now very little.
B. Clubs
In 2019, the Texas Legislature, while considering decriminalizing
knuckles, noticed that the prohibition on carrying clubs made little
sense and was no longer necessary. Therefore, at the same time it
eliminated knuckles from the entire Texas Penal Code, it removed
the unlawful carrying of clubs, generally in public. However,
since Section 46.03 of the Texas Penal Code continues to prohibit
the carrying of clubs into specific secure locations (i.e., schools,
polling places, etc.), a discussion of clubs therefore continues to
be enlightening.
