B. The “particularity requirement”
The text of the Fourth Amendment dictates that warrants must
“particularly describe” the person or place at issue. How does this
“particularity requirement” look in practical application? The warrant
must specifically identify the person to be arrested, or describe the
property to be searched and seized. It must be done in such a manner
that the average person could find the location or identify the persons
and places named in the warrant. In an arrest warrant, particularity
is generally satisfied by including the name and date of birth of the
