B. What are the usual steps for buying or manufacturing
NFA items?
PRACTICAL LEGAL TIP
Whether a person is buying or making (manufacturing) an NFA
firearm, there are several steps in the process. The transfer or
manufacture of an NFA firearm requires the filing of an appropriate
form with the ATF, payment of any federally mandated tax,
approval of the transfer or making by the ATF, and registration of
the firearm to the transferee or maker. Only after these steps have
occurred may a buyer legally take possession of the NFA item, or
may a person legally assemble or manufacture the NFA item. In
this section, we will walk through the process, step by step, of: (1)
purchasing an NFA item that already exists; and (2) manufacturing
an NFA firearm.
Even if you don’t own a machine gun
today, that doesn’t mean you won’t
be the intended owner of one later. A
person could always leave you their
NFA items in a will. If this happens,
you must file the appropriate
paperwork with the ATF as soon as
possible, or at least before probate is

Steps for buying an existing NFA item (for example, a suppressor):
1)select and purchase the item (suppressor) from a transferor
who is usually an FFL dealer who is authorized to sell NFA
weapons;
2)assemble appropriate paperwork: ATF Form 4 (see Appendix
C), fingerprints on an FBI Form FD-258, a passport-size
photograph, and a payment for the tax of $200
