D. Which way should I own my NFA item? Paperwork
requirements for individuals, trusts, or business entities to own
NFA items
Form 4 and Form 1 are the appropriate paperwork that must be
assembled and submitted to the ATF under the NFA and varies
depending on whether an individual or a legal entity such as a trust,
corporation, or partnership is purchasing or manufacturing the NFA
item. The paperwork generally starts either with an ATF Form 4
used for purchasing an existing item, or an ATF Form 1 which
is used if a person wishes to manufacture a new NFA item. All
relevant portions of the forms must be completed. Both Form 4 and
Form 1 have a requirement that a Chief Law Enforcement Officer
for the city or county where the applicant lives must be given their
copy of the ATF Form.
Who is a Chief Law Enforcement Officer who must be notified? For
the purposes of ATF Form 4 or Form 1 and the responsible person
questionnaire, ATF Form 5320.23, the Chief Law Enforcement
Officer is considered to be the chief law enforcement officer
who has jurisdiction where the transferor, the applicant, and any
“responsible persons” are located. These persons include “the
Chief of Police; the Sheriff; the Head of the State Police; or a State
or local district attorney or prosecutor.”
Photograph and fingerprints are required for individual applicants
and “responsible persons.” If an individual is purchasing or
manufacturing an NFA item, the applicant must submit an
appropriate photograph and their fingerprints. An entity such as
a trust or corporation must designate “responsible persons” who
are allowed to have access to use and possess an NFA weapon.
